SMS / Text Messaging Terms
& Conditions

These SMS Terms & Conditions govern your enrollment in and use of text messaging programs operated by BioPhoenix Inc.

1. Program Description

When you provide your mobile phone number and check the consent box on any BioPhoenix form, you are enrolling in BioPhoenix’s text messaging program.

The messages you may receive include:

  • Marketing and promotional messages about BioPhoenix wellness protocols, programs, special offers, and educational content.
  • Appointment-related messages including consultation reminders, scheduling confirmations, and rescheduling notices.
  • Account and order messages including order confirmations, shipping updates, payment notifications, and protocol-related communications.
  • Transactional messages related to your active wellness protocol, including check-in prompts and lab work reminders.

Different message types may be sent at different frequencies. By providing consent, you authorize BioPhoenix to send all of the above message types to the number you provided.

2. Consent

Consent is required. You must check the SMS consent checkbox on a BioPhoenix form to enroll in our text messaging program.

By checking that box and submitting the form, you provide your prior express written consent to receive text messages from BioPhoenix at the mobile number provided, including messages sent using an automatic telephone dialing system (autodialer) or pre-recorded voice technology.

Consent is not a condition of purchase or service. You are not required to consent to receive marketing text messages in order to use BioPhoenix services.

You must be 18 years of age or older to enroll in BioPhoenix text messaging.

3. Message Frequency

Message frequency varies based on your activity, the programs you have enrolled in, and BioPhoenix’s marketing schedule.

Marketing message frequency is generally limited to no more than [X] messages per month per recipient.

4. Message and Data Rates

Message and data rates may apply. Standard message and data rates from your wireless carrier apply to all messages sent and received under this program.

BioPhoenix is not responsible for any charges from your wireless carrier related to text messages sent to or received from BioPhoenix.

5. How to Opt Out

  • Reply STOP to any text message from BioPhoenix.
  • You may also reply with END, CANCEL, UNSUBSCRIBE, or QUIT.
  • After replying STOP, you will receive one final confirmation message.
  • You may also opt out by emailing support@aadilk.com.

Important: Opting out of marketing messages does not affect transactional messages related to your active wellness protocol, your account, or your orders.

7. Supported Carriers

The BioPhoenix text messaging program is supported by major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, and other carriers.

Carriers are not liable for delayed or undelivered messages.

8. Mobile Number Changes

If you change your mobile phone number or no longer have access to the number you provided to BioPhoenix, you must update your account information promptly.

You agree to indemnify and hold BioPhoenix harmless from any claims resulting from your failure to update your mobile phone number.

9. Privacy

Your mobile phone number and the contents of your text message communications with BioPhoenix are subject to our Privacy Policy.

BioPhoenix does not sell your mobile phone number to third parties.

Some text messages may relate to your wellness protocol or interactions with licensed providers. Standard SMS is not encrypted end-to-end, and there are inherent privacy risks associated with transmitting health-related information via standard text message.

10. Disclaimers

Text messages from BioPhoenix do not constitute medical advice, diagnosis, or treatment.

If you are experiencing a medical emergency, call 911 immediately.

BioPhoenix is not responsible for delayed, undelivered, or misdirected messages.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BioPhoenix and its affiliates shall not be liable for any damages arising out of or related to your participation in the BioPhoenix text messaging program.

12. Modifications

BioPhoenix may modify these SMS Terms at any time by posting an updated version on this page with a revised Last Updated date.

13. Governing Law

These SMS Terms are governed by the laws of the State of New Jersey and applicable federal law including the Telephone Consumer Protection Act (TCPA).
